Earlier today, NCTA held a media briefing to highlight the significant legal vulnerabilities of the FCC’s set-top box proposal. The call featured NCTA President & CEO Michael Powell and NCTA outside counsel Ted Olson and Helgi Walkers, partners at Gibson, Dunn & Crutcher law firm in Washington, D.C. As part of the briefing, the attached summary of a legal white paper, The FCC’s “Competitive Navigation” Mandate: A Legal Analysis of Statutory and Constitutional Limits on FCC Authority was distributed.
