“The Commission’s decision to break with the FTC’s proven privacy framework in favor of a cobbled-together approach that abandons principles of fair competition is profoundly disappointing. Instead of creating a consistent and uniform approach to privacy that consumers can easily understand, today’s result speaks more to regulatory opportunism than reasoned policy. We strongly agree with the bipartisan Commissioners’ comments that the federal government should develop a common approach to online privacy, as there is no lawful, factual or sound policy basis to justify a discriminatory approach

"The Chairman’s Fact Sheet describes a regime that departs from the FTC’s proven sensitivity-based approach to consumer privacy in several key respects. Specifically, in its treatment of web browsing data and first party marketing of ISP services, the FCC departs from past FTC practice in ways that violate principles of fair competition and deny consumers the benefit of a consistent approach to online privacy protection. If the Chairman insists on advancing this approach, we would hope that his fellow commissioners would ‘opt-out’ and seek a result more faithful to the FTC’s proven framework

"Today the Wi-Fi Alliance released a plan for testing whether a LTE-U device shares fairly without disrupting consumers' Wi-Fi devices. This test plan represents a year of hard work by the Wi-Fi Alliance and by a diverse group of industry stakeholders, all of whom made significant compromises to reach a final result based on sound engineering principles. Although the details of test plan execution at each lab remain important, NCTA urges the FCC to rely on test results that implement the Wi-Fi Alliance plan in its entirety in deciding whether to approve LTE-U devices."
