NCTA Comments re: Implementation of Section 621(a)(1) of the Cable Communications Policy Act of 1984 as amended by the Cable Television Consumer Protection and Competition Act of 1992, stating that the Commission did not have an adequate factual basis to reach the conclusions it did as to whether telephone companies needed relief from local franchising obligations and that the Commission did not have the legal authority to adopt rules or provide its “guidance.”; MB Docket No. 05-311
